Terms of Use & Platform Disclaimer

1. Acceptance

By accessing or using Koochbhi you agree to these Terms, the Privacy Policy, applicable in-product notices and any transaction-specific terms you expressly accept. If you do not agree, do not use the Platform.

2. Platform role

Koochbhi is a technology marketplace/facilitation and coordination platform. Except where Koochbhi expressly enters into a separate written contract stating otherwise, Koochbhi is not a party to the underlying work arrangement between users and is not the employer, employee, principal, agent, contractor, subcontractor, labour supplier, recruiter or representative of a user merely because the Platform introduces, matches or enables communication between users.

3. Independent user responsibility

Each user independently decides whether to post, respond, engage, meet, hire, work, pay, accept payment, continue, cancel or complete a transaction. Users are responsible for their own due diligence, identity checks, qualifications, licences, permits, tax treatment, labour-law compliance, safety precautions, insurance, tools, supervision, compensation arrangements and lawful conduct.

4. No guarantee of user statements or performance

Koochbhi does not warrant that user-supplied information is accurate, complete, lawful or truthful. A user may misstate identity, skill, experience, availability, ability, price, intention or other information. Users must independently verify matters material to their decision. Verification badges, scores, references, ratings or safety indicators are signals only and are not guarantees.

5. No employment, income or work guarantee

Registration, matching, responding or appearing in search results does not create employment and does not guarantee work, earnings, minimum wages, continuity, hours, benefits, insurance, social-security status or any particular outcome. Where a law imposes obligations on a user or on Koochbhi that cannot lawfully be excluded, those obligations remain applicable.

6. Prohibited conduct

Users must not impersonate others, provide materially false information, post unlawful work, discriminate unlawfully, harass or threaten others, solicit illegal goods/services, misuse personal data, circumvent safety controls, share another person’s OTP/PIN/password, commit fraud, exploit minors, violate labour or immigration rules, or use Koochbhi to facilitate crime or abuse.

7. Safety

Users are responsible for evaluating the safety of people, locations and work before meeting or beginning work. Emergency or panic features, sharing tools and verification signals are supplemental aids only. In an emergency, users should contact the appropriate emergency service or law-enforcement authority. Koochbhi does not provide security personnel and cannot guarantee prevention of misconduct.

8. Pricing and payments

Unless the Platform expressly states otherwise, users determine or accept their own work price and commercial terms. Beta payment flows may be sandbox/test-only. Live payments, when enabled, may be processed by third-party payment providers and are subject to provider terms, banking rules, reversals, fraud controls and applicable taxes. Users must never share OTPs, UPI PINs, card PINs or banking passwords with another user.

9. User disputes

Users should first attempt to resolve disagreements directly and lawfully. Koochbhi may offer support, evidence logs, dispute tools or account restrictions, but is not required to adjudicate private contractual disputes unless applicable law requires otherwise. Koochbhi may cooperate with lawful requests from competent authorities.

10. User-generated content

Users retain responsibility for content they submit. By submitting content needed to operate the Platform, users grant Koochbhi a limited licence to host, process, display, translate, transmit and use that content for providing, protecting and improving the Platform. Users must have the right to submit the content and must not infringe third-party rights.

11. Suspension and removal

Koochbhi may restrict, suspend, remove or investigate accounts, content, listings or transactions where reasonably necessary for safety, security, suspected fraud, legal compliance, abuse prevention or enforcement of these Terms, subject to applicable law.

12. Third-party services

Maps, location, speech recognition, communications, app stores, identity/verification providers and payment services may be provided by third parties. Koochbhi is not responsible for failures, outages, independent processing or acts of third parties outside Koochbhi’s reasonable control.

13. Beta status

During beta, features may be incomplete, changed, withdrawn, interrupted or unavailable. Test data, sandbox payments and experimental features must not be treated as production guarantees. Users should report errors and should not rely on beta functionality for safety-critical or legally time-sensitive decisions.

14. Disclaimer of warranties

To the maximum extent permitted by law, the Platform is provided on an “as is” and “as available” basis. Koochbhi does not promise uninterrupted availability, error-free operation, successful matching, user honesty, competence, legal compliance, job completion, payment, safety, income or any particular commercial result.

15. Limitation of liability

To the maximum extent permitted by applicable law, Koochbhi and its directors, officers, employees and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive loss arising from user conduct, inaccurate user statements, failed or defective work, non-payment, injury, property loss, fraud, theft, harassment, discrimination, unlawful activity, third-party services, device/network failure or unauthorised use, except to the extent liability cannot lawfully be excluded or limited. Nothing here excludes liability that Indian law makes non-excludable.

16. Indemnity

To the extent permitted by law, a user agrees to be responsible for losses, claims, penalties and reasonable costs arising from that user’s unlawful conduct, material breach of these Terms, infringement of third-party rights or false/misleading information, except to the extent caused by Koochbhi’s own non-excludable legal responsibility.

17. Compliance with law

Users must comply with all laws applicable to their activity, including labour, employment, wage, tax, professional licensing, consumer, safety, anti-discrimination, child-protection, criminal and local regulatory requirements where relevant. Koochbhi’s role as a platform does not relieve a user of obligations imposed directly on that user by law.

18. Connected services and ScoreBaba.com

Koochbhi may introduce optional integrations with other identified digital services, including ScoreBaba.com. Such integrations may allow a user to carry selected information, profile attributes, transaction history, capability indicators or other authorised data between services for matching, personalisation, fraud prevention, account continuity, human-potential insights or other disclosed purposes.

Koochbhi does not sell personal data. If an integrated service is operated by another legal entity, or if a new purpose requires separate consent under applicable law, the user will be shown the relevant disclosure before the integration is activated. Use of an optional connected service may be declined unless the relevant information is genuinely required for the specific feature requested.

20. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to any mandatory jurisdiction or statutory forum that cannot lawfully be excluded, disputes concerning these Terms or the Platform will be subject to courts/competent forums at Mumbai, Maharashtra, India.

Eligibility

You must be at least 18 years old and able to enter a binding contract under Indian law to create an account or accept a job. When you register you confirm that you are 18 or older. If we find or reasonably suspect that an account belongs to a person under 18, we may suspend it and ask for proof.

Fees

No platform fee is charged during the current pilot. If a fee is introduced, it will be shown before you agree to a job, with taxes. See Payments & Settlement.

Content rights

You keep ownership of what you submit. You give Koochbhi the limited licence in section 10 to run the Platform. You must not upload content you do not have the right to use.

Moderation, complaints and appeals

Our rules are in the Community Rules. You can report a problem or make a complaint at Report an issue and appeal a decision there. Complaint handling is described at Grievance Redressal. Cancellation and refunds are described at Cancellation & Refunds.

Your statutory rights

Nothing in these Terms removes any right or remedy you have under Indian consumer-protection, data-protection, intermediary or other law that cannot lawfully be excluded.

21. Changes

Koochbhi may update these Terms for legal, security, operational or product reasons. The effective date will be updated and additional notice provided where required by law.

These Terms are drafted for the beta platform and should be reviewed by Indian counsel before large-scale commercial launch, especially where regulated work, live payments or additional verification products are introduced.
